Terms and Conditions

1. Applicability of the Terms
These Terms and Conditions apply to all agreements between the Client and Nurturing Minds Psychologists regarding individual psychological treatment, group programmes, and related professional services. If a specific situation is not explicitly addressed or there is uncertainty about interpretation, it shall be resolved according to the intent of these Terms.
By engaging in services, the Client agrees to these Terms.

Services are provided by a BIG-registered Healthcare Psychologist (GZ-psycholoog) in accordance with Dutch professional regulations.
Certain services may involve collaboration with other qualified professionals. Where applicable, such professionals act under independent professional responsibility or as engaged service providers, in accordance with Dutch law and applicable professional standards.
All services are delivered in compliance with relevant legal, ethical, and quality standards.



3. Formation of the Agreement
The agreement is formed when:


• The Client requests services, and


• Nurturing Minds Psychologists confirms acceptance.

 


If the request cannot be accommodated, the Client will be informed and, if relevant and possible, redirected to another professional. The agreement remains in effect for the duration of the service unless terminated in accordance with these Terms or applicable law.

4. Scope of Services
Services may include:
a) Individual Psychological Treatment
Clinical psychological services are provided by a BIG-registered GZ-psycholoog in
accordance with the Dutch Medical Treatment Agreement Act (WGBO) and applicable
professional regulations.
b) Preventive and Psychoeducational Group Programmes
Group programmes are preventive and educational in nature. They are not individual
psychotherapy, do not constitute medical treatment under the WGBO, and are not a
substitute for individual mental health care.
Participation in group programmes does not establish an individual medical treatment
agreement unless explicitly agreed in writing.


5. Fees and Payment
Fees and Payment
Fees are communicated prior to the commencement of services.


All services must be paid in full in advance. Payment is required before the scheduled appointment or the start of a group programme. A booking is only confirmed once payment has been received.
Invoices are issued directly by Nurturing Minds Psychologists in euros (EUR).


 

Psychological treatment provided by a BIG-registered Healthcare Psychologist in the Netherlands may qualify for VAT exemption under Article 11(1)(g) of the Dutch VAT Act.

 


Preventive and psychoeducational group programmes may fall outside this exemption. VAT will be applied where required under Dutch tax law.
Failure to complete payment before the scheduled service may result in cancellation of the appointment or participation.


6. VAT Exemption (Netherlands)
Psychological services delivered in the Netherlands by BIG-registered psychologists are
exempt from VAT (0 %) under Article 11(1)(g) of the Dutch VAT Act (Wet op de
omzetbelasting 1968). Therefore, no VAT will be charged on such clinical services.
Psychoeducational group programmes that do not constitute healthcare treatment may fall
outside this exemption and are priced accordingly.


7. Cancellations, Withdrawals, and Refunds


Individual Sessions (including intake) 


Appointments may be cancelled or rescheduled free of charge up to 24 hours before the scheduled time.
Late arrivals will not extend the session time beyond the originally scheduled ending time. All requests for cancellations or rescheduling must be submitted in writing via email to: contact@nurturingmindshc.com


Cancellations made less than 24 hours in advance, or non-attendance for any reason, will be fully charged.


Group Programmes 


Participation may be cancelled up to 15 days before the start date of the programme. After this period, payments are non-refundable.
Once the programme has commenced, no refunds or rescheduling of missed sessions are possible.
Group programmes are subject to a minimum number of participants.
 Nurturing Minds Psychologists reserves the right to cancel or postpone a group programme if the minimum number of participants is not reached.
In such cases, participants who have already made payment will receive a full refund of the amount paid. No additional compensation shall be due.


8. Online Sessions
Online sessions are provided via secure digital platforms.
The Client is responsible for ensuring that:
• They are located in a private and confidential environment,
• The setting is appropriate for therapeutic work (free from interruptions, distractions, or
the presence of third parties),
• A stable internet connection and suitable technical equipment are available.
Sessions may not be recorded by the Client without prior written consent.
Online services do not constitute emergency or crisis care. In the event of acute crisis, the
Client must contact local emergency services.
If technical difficulties significantly interfere with the session, reasonable efforts will be made
to reschedule or continue via alternative means, at the discretion of Nurturing Minds Psychologists.

Significant technical difficulties or an environment that is not considered sufficiently private or appropriate for therapeutic work may, in some situations, be considered a missed appointment or late cancellation if the session cannot reasonably take place or continue.


9. Confidentiality
All personal and clinical information is treated as strictly confidential in accordance with:
• GDPR
• WGBO
• Dutch professional confidentiality obligations
Information will only be disclosed with the Client’s explicit consent or when legally required.


10. Client Responsibilities
The Client is responsible for:
• Providing accurate and complete information
• Attending sessions punctually
• Participating actively in the therapeutic process

• Ensuring appropriate setting for a safe session in online sessions.
Respectful conduct is required at all times. Aggressive or inappropriate behaviour may result
in immediate termination of services without refund.


11. Professional Standards and Quality of Care
Services are delivered with due professional care in accordance with Dutch ethical and
professional standards. Objectives are periodically reviewed to ensure continued
appropriateness.
While every effort is made to provide high-quality support, no specific therapeutic outcome
can be guaranteed.


12. Emergency and Crisis Situations
Services provided by Nurturing Minds Psychologists do not constitute emergency or
crisis care.
In case of acute crisis, suicidal ideation, or medical emergency, the Client must contact:
• GP
• GP out-of-hours (huisartsenpost)
• Crisisdienst in your area
• 112 (The Netherlands emergency number) 

 

13. Continuity of Care & Service Limitations

This practice aims to provide consistent and thoughtful psychological support within the scope of outpatient mental healthcare. At the same time, it is important to understand that this practice does not provide 24/7 availability, emergency psychiatric care, crisis intervention, or intensive multidisciplinary support services.


Continuity of care will be maintained as carefully as possible throughout the therapeutic process. However, situations such as extended leave, illness, holidays, professional limitations, clinical indication, or changes in therapeutic needs may occasionally require temporary adjustments, referral, or transition of care.


Whenever possible, these situations will be communicated and explored openly together in order to support continuity, clarity, and appropriate clinical care.


14. Exclusion Criteria

We do not provide treatment for individuals under 18 years of age, or  adults with primary concerns such as:
• Active suicidality
• Psychotic disorders
• Severe and chronic psychiatric conditions
• Eating disorders
• Addictions
• Severe personality disorders
• We do not specialize in coaching for ADHD, ADD, or autism spectrum disorders

15. Limitation of Liability

Liability is limited to direct damages resulting from intentional or grossly negligent conduct.
Total liability shall not exceed the amount paid by the Client for the specific service in question.
 Nurturing Minds Psychologists is not liable for indirect or consequential damages.
Clients remain responsible for their own actions and decisions.
Psychoeducational and group programmes are not a substitute for individual mental health treatment or emergency care. Clients are responsable for seeking appropriate medical or psychiatric support when needed.
Nothing in these Terms excludes liability where exclusion is not permitted under Dutch law.

16. Complaints Procedure
Complaints should first be addressed directly to
Nurturing Minds Psychologists. Both parties shall make every reasonable effort to resolve disputes amicably through constructive discussion or mediation.

If a complaint cannot be resolved informally, the Client may refer the matter in accordance with the Wet kwaliteit, klachten en geschillen zorg (Wkkgz) to the appropriate independent complaints body.

Nurturing Minds Psychologistsis affiliated with the complaints and disputes framework provided through the Nederlands Instituut van Psychologen (NIP) and collaborates with the independent complaints management organisation:

Geschillencommissie Vrijgevestigde GGZ Praktijken

Clients who wish to submit a formal complaint may request the most up-to-date complaints information and official complaint form directly from
Nurturing Minds Psychologists. This information will be provided without undue delay.

Formal complaints may also be submitted digitally using the official CBKZ complaints form through the link provided by
Nurturing Minds Psychologists upon request.

17. Insurance and Reimbursement

Nurturing Minds Psychologists operates primarily as a private practice and does not hold contracts with Dutch health insurance companies.

Depending on the client’s insurance policy, partial reimbursement may be possible through Dutch or international insurance providers. However, reimbursement is never guaranteed and remains entirely the responsibility of the client.

Clients are solely responsible for:

* verifying coverage and reimbursement conditions with their insurance provider prior to starting treatment;
* obtaining any required GP referrals, or supporting documentation requested by their insurer;
* submitting invoices independently to their insurance company;
* managing all communication and administrative procedures with their insurer.


Nurturing Minds Psychologists does not contact insurance companies directly and does not provide additional reports, forms, letters, treatment summaries, or administrative documentation beyond the standard invoices and approval requests.

All sessions remain fully payable in advance by the client regardless of reimbursement decisions made by the insurance provider.


18. Governing Law and Jurisdiction
These Terms are governed exclusively by Dutch law.
Any disputes arising from these Terms shall be submitted to the competent courts of the
Netherlands, without prejudice to mandatory consumer protection rights under EU law.


19. Amendments
These Terms and Conditions may be updated to reflect changes in law or professional
practice. The most recent version will be published on the website.
Continued use of services constitutes acceptance of the updated Terms.
